These General Terms and Conditions apply to orders of goods placed by consumers via the online shop https://drgabriels.eu/. We currently deliver to Austria only. The version of these Terms and Conditions in force at the time of the order applies.
A consumer is any person who enters into a legal transaction for purposes that cannot predominantly be attributed to their commercial or independent professional activity.

The online shop operates under the brand “Dr. Gabriel’s SUPERHERBS”.
We mainly sell food supplements. The essential product characteristics, ingredients, recommended daily intake, quantities and any legally required information are stated in the respective product description and labelling.
Food supplements are foods and are not a substitute for a varied and balanced diet and a healthy lifestyle. Products are not offered as medicinal products. Legally required directions for use and warnings must be observed.
The presentation of goods in the online shop does not constitute a legally binding offer on our part. You can add products to the shopping cart without obligation, check your details and correct them until you submit the order.
By clicking the order button that is clearly marked as involving an obligation to pay, you submit a binding offer to purchase the goods in the shopping cart. You will then receive an electronic confirmation that we have received your order. This automatic confirmation of receipt does not in itself constitute acceptance of the contract.
The purchase contract is concluded when we expressly confirm acceptance or when the goods are dispatched. If a payment has already been initiated without a contract being concluded, any amount collected will be refunded. The specific technical payment authorisation for individual payment methods may depend on the payment method chosen.
The language of the contract is German. We provide you with the order information and the legally required contract information in electronic form.
All final prices shown in the shop are stated in euros (€) and include the applicable statutory VAT, where applicable.
For deliveries within Austria we charge a flat shipping fee of €6.00 per order. For orders of €80.00 or more (including VAT, after deduction of any discounts and vouchers) we deliver free of charge within Austria. The total price including any shipping costs is shown in the checkout before the order is completed.
Payments are processed via Stripe and the payment methods available in the checkout. We currently offer in particular credit card (Visa, Mastercard), Apple Pay, Google Pay, EPS and SEPA Direct Debit.
Which payment method can actually be used for a specific order depends on the options shown in the checkout and, where applicable, the terms of the respective payment service. EPS is an online banking payment method; SEPA Direct Debit is not a conventional manual bank transfer.
We currently deliver within Austria only. Deliveries are mainly made by DPD. In individual cases we may use another suitable shipping provider.
The delivery time is up to seven working days from receipt of the order. Working days are Monday to Friday, excluding public holidays relevant to processing and delivery. Orders received on Saturdays, Sundays or on relevant Austrian national, regional or local public holidays are processed on the next working day. The calculation of working days takes these non-working days into account. If the chosen payment method results in a separate processing time, we will inform you of this before the contract is concluded, insofar as this affects the stated delivery time.
If a foreseeable delivery delay occurs in an individual case, we will inform you. Your mandatory statutory rights in the event of late delivery remain unaffected.
In consumer transactions, the risk of accidental loss of or accidental damage to the goods generally passes to you only when the goods are handed over to you or to a person designated by you who is not the carrier, unless otherwise provided by law.
For distance contracts, consumers generally have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods. If several goods from one order are delivered separately, the period generally begins upon receipt of the last item.

of your decision to withdraw from the contract by means of a clear statement (for example by letter or email). To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period has expired.
You can use the model withdrawal form printed at the end of these Terms and Conditions for this purpose; this is not mandatory. Where a statutory right of withdrawal exists, you can also exercise it via the easily accessible online withdrawal function “Withdraw from contract” on our website (link in the footer of every page). There you enter your order number and the email address used for the order and then confirm the withdrawal. We will send you an acknowledgement of receipt without delay on a durable medium (usually by email), containing the content of your withdrawal notice and the date and time of receipt. Partial withdrawal for individual items is also possible. Using this online function is voluntary; withdrawal by email or letter remains possible.
If you withdraw from the contract, we will refund all payments we have received from you, including the cost of the cheapest standard delivery offered (but not any additional costs resulting from your choice of a more expensive type of delivery), without delay and no later than 14 days from receipt of your notice of withdrawal. We will generally use the same means of payment as for the original transaction for the refund, unless expressly agreed otherwise; you will not be charged any fees for this.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to the following address without delay and no later than 14 days from the day on which you inform us of your withdrawal:

The deadline is met if you send the goods before the 14-day period has expired. You bear the direct costs of returning the goods, insofar as this is legally permissible and you were properly informed of this before the contract was concluded.
You are only liable for any loss in value of the goods if this loss results from handling the goods in a way that was not necessary to establish their nature, characteristics and functioning, insofar as provided by law.
Under the conditions of § 18 of the Austrian Distance and Off-Premises Contracts Act (FAGG), the statutory right of withdrawal may not apply in particular to sealed goods which are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery. Whether such an exception actually applies to a specific product is determined solely by the statutory requirements. Our voluntary 60-day money-back guarantee described below expressly also applies to opened and used products.
In addition to your statutory rights, BOSMEN GmbH grants a voluntary 60-day money-back guarantee on all products you purchase in our online shop www.drgabriels.eu.
The guarantee period begins on the day you receive the product. The guarantee expressly also applies if the packaging has been opened or the product has already been used.

You bear the direct costs of the return. After receiving and matching your return, we will refund the full purchase price of the returned product under the voluntary guarantee, i.e. 100 % of the product price. Any flat shipping fee charged for the order (€6.00) is not refunded under this voluntary additional guarantee, unless a statutory right requires a refund anyway.
This guarantee does not in any way restrict your mandatory statutory rights, in particular your statutory right of withdrawal and your warranty claims. For statutory withdrawals, the statutory refund rules explained in section 8, which may be more favourable, apply. The 60-day guarantee is an additional contractual return option and is not limited by the statutory withdrawal button. It can also be claimed by contacting info@drgabriels.eu.
The mandatory statutory warranty rights under Austrian law apply, in particular the Austrian Consumer Warranty Act (VGG), where applicable. If defects occur, you have the statutory rights to have the goods brought into conformity with the contract and, under the statutory conditions, to a price reduction or termination of the contract. The statutory warranty periods and special statutory provisions remain authoritative.
The voluntary 60-day money-back guarantee is independent of this.
The goods remain our property until the purchase price has been paid in full, insofar as legally permissible.
